Anti-Spam & Abuse Policy
1. Our Commitment
BrainSource is committed to responsible, permission-based communication. This Anti-Spam Policy explains how we collect, use, and manage contact information, and the standards we hold ourselves to when sending emails, newsletters, and other electronic communications. This policy applies to all communications sent by BrainSource, including marketing emails, recruitment outreach, newsletters, and client or candidate correspondence.
We comply with applicable anti-spam laws, including the U.S. CAN-SPAM Act, the EU’s General Data Protection Regulation (GDPR), and relevant national e-privacy regulations in the countries where we operate or communicate with recipients, including Poland and Romania.
2. What We Consider Spam
We define spam as any unsolicited electronic communication sent without the recipient’s consent, or that misrepresents its sender, subject matter, or purpose. BrainSource does not send, and does not permit any employee, contractor, or partner acting on our behalf to send, communications that:
- Are sent without a legitimate business relationship or documented consent
- Use false, misleading, or deceptive subject lines or sender information
- Disguise the commercial nature of the message
- Are sent to purchased, harvested, or scraped email lists
- Fail to provide a clear and functioning way to opt out
- Continue after a recipient has unsubscribed or requested no further contact
3. How We Collect Contact Information
BrainSource only communicates with individuals who have engaged with us directly or through a legitimate business channel. This includes people who:
- Submit an inquiry through our website or contact forms
- Apply for a role or express interest in our recruitment services
- Are existing or prospective clients who have engaged in business discussions with us
- Have explicitly opted in to receive updates, newsletters, or market reports
- Are professional contacts reached through legitimate, individually reviewed business outreach relevant to our recruitment services
We do not purchase, rent, or use third-party email lists for bulk marketing purposes.
4. Consent and Opt-In Practices
Where required by law, particularly for recipients in the European Union, we obtain explicit consent before sending marketing communications. Consent is collected through clear, unambiguous actions, such as checking an opt-in box or submitting a form that explicitly describes what the recipient is signing up to receive.
For business-to-business outreach related to recruitment services, where a legitimate interest basis may apply under GDPR, we ensure communications are relevant to the recipient’s professional role, clearly identify BrainSource as the sender, and always include a straightforward way to decline further contact.
5. Your Right to Opt Out
Every marketing email from BrainSource includes a visible, functioning unsubscribe link. Recipients may opt out of future communications at any time by:
- Clicking the unsubscribe link included in any marketing email
- Emailing us directly at abuse@brainsource.io with an opt-out request
- Contacting us through the form on our website
We process opt-out requests within 10 business days, in line with CAN-SPAM requirements, and typically much sooner. Once a recipient opts out, we will not sell, transfer, or share their contact information with any third party for marketing purposes.
6. Accurate Sender Identification
All communications from BrainSource clearly identify us as the sender, including our legal business name and a valid physical or registered business address, in accordance with CAN-SPAM requirements. We do not use misleading “From” names, spoofed domains, or deceptive subject lines designed to obscure the origin or intent of a message.
7. Third-Party Vendors and Tools
BrainSource may use third-party email service providers and marketing platforms to send communications on our behalf. Any vendor we work with is contractually required to comply with applicable anti-spam laws and this policy, including honoring opt-out requests and maintaining appropriate data security standards.
8. Reporting Abuse or Policy Violations
If you believe you have received an unsolicited communication from BrainSource or wish to report domain abuse, please contact us directly at abuse@brainsource.io. Include the full message headers and email body so we can investigate immediately.
